When you use our software, you’re trusting us with your information. We understand this is a big responsibility and work hard to protect your information and put you in control.

Data Security. All documents and electronic data inputted by User shall remain the sole property of User and shall not be accessible to company users (except for SOILMAP administrators) or any other users of the SOILMAP Software. No other users of the SOILMAP Software shall be able to access User’s printers. No data inputted by User shall be retained by SOILMAP after the termination of this Agreement (provided User account is paid in full). SOILMAP shall also back up all data three times weekly and store off-premises. SOILMAP shall make every effort to protect said data but does not guarantee the data in instances of defective media or natural disasters beyond SOILMAP’s control.

Disclaimer of Warranties. SOILMAP DOES NOT WARRANT THE SERVICES AND SOFTWARE PROVIDED UNDER THIS AGREEMENT, OR THAT THE SOFTWARE WILL MEET OR CONTINUE TO MEET THE SPECIFICATIONS, OR THAT ANY OR ALL ERRORS, MALFUNCTIONS, AND DEFECTS CAN AND WILL BE CORRECTED. ALL CORRECTIONS, PROGRAMS, INFORMATION AND SERVICES ARE PROVIDED ON AN “AS IS” BASIS, AND THERE ARE NO WARRANTIES EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY WARRANTIES OF MERCHANTABILITY OF THE COMPUTER PROGRAM, INFORMATIONAL CONTENT, OR FITNESS FOR LICENSEE’S PURPOSE OR SYSTEM INTEGRATION. THERE IS NO WARRANTY AGAINST INTERFERENCE WITH YOUR ENJOYMENT OF THE LICENSED PRODUCT OR AGAINST INFRINGEMENT OF THE INTELLECTUAL PROPERTY RIGHTS OF ANOTHER. SOILMAP  HEREBY EXPRESSLY DISCLAIMS ALL WARRANTIES AND MAKES NO REPRESENTATIONS OR GUARANTEES OF ANY KIND, WITH RESPECT TO YIELD PERFORMANCE, OR ACCURACY OF ANY SOIL, FERTILITY, OR OTHER INFORMATION PRODUCED BY THE MAPS SOFTWARE; OR WITH RESPECT TO ANY RECOMMENDATIONS FROM NEW COOP BASED ON SUCH INFORMATION.

Limitation of Liability. Neither SOILMAP nor its employees or agents involved in the creation, production, testing or delivery of the SOILMAP Program shall be liable for any direct, incidental or consequential damages such as, but not limited to, loss of profits or benefits, resulting from the use of the SOILMAP Software or MAPS program. In granting the license herein to User, SOILMAP shall not in any way be responsible for the actual application of agricultural products by User or User’s customer
